Time specifically stated in an employment contract that employers use to assess a new hire’s suitability for a job. The Ontario Employment Standards Act, 2000 sets a period of three months as the maximum time for this assessment. If the new hire is dismissed during this time frame, no termination compensation will be owing unless the dismissal was in bad faith. Employers may choose a longer time, but if the employee’s employment is terminated beyond the three-month limit, termination compensation will be owed.
