A partial defence that reduces murder to manslaughter. It is available when the deceased commits an indictable offence punishable by five years’ or more imprisonment (such as assault or sexual assault) in circumstances that would make an ordinary person lose self-control, and that caused the accused suddenly and subjectively to be provoked and kill before his or her passions had cooled.
