Tort liability based solely on the causation of damage rather than proof of the defendant’s intent or negligence.


An offence for which the Crown must prove the commission of the prohibited act beyond a reasonable doubt. The existence of negligence is then presumed unless the accused establishes a defence of due diligence on a balance of probabilities.
