Term from the Fifth Amendment of the US Constitution: an expropriation or a very severe diminution of value of property of a private owner to the benefit of the government taker; see Lucas v South Carolina Coastal Council, 505 US 1003 (1992); although not a part of Canadian constitutional law, the term “taking” is sometimes used in Canadian cases.
