Case Review of Decertification Motions in Class Proceedings

This article provides an overview of the test for decertification and reviews recent instances in which decertification motions have been successfully used in Canada where new evidence, subsequent facts, or developments have arisen after certification. It will also highlight certain cases where courts, instead of granting decertification, have adopted alternative measures to address the concerns raised by the defendants.
